Post-Conviction Relief Litigation
Post-conviction relief is a mechanism in which a person convicted of a crime can seek to reverse their convictions and/or sentences based on constitutional violations that occurred during the criminal trial court proceedings. In a post-conviction case, a person can only challenge constitutional violations that could not have been addressed during direct appeal. Ineffective assistance of counsel is by and large the most common constitutional violation addressed in post-conviction proceedings. A person must successfully prove, by a preponderance of the evidence, two elements in order to prevail in a post-conviction case dealing with the ineffective assistance of counsel: (1) their trial attorney failed to act within reasonable professional norms (in layman's terms, the trial attorney made a mistake), and (2) the trial attorney’s performance prejudiced the client.
